本条例将经英国1968年《设计版权法》修订之英国1956年《版权法》加以修改,以便引用于香港,并就香港版权法例制订进一步的规定。

1.简称
本条例定名为版权条例。
2.释义
(1)在本条例内,除按照上下文另具意义者外,下开各词应解释如下??
“版权法”指经英国1968年《设计版权法》修改之英国1956年《版权法》;
“获授权人员”指获总监书面授权执行及行使本条例赋予获授权人员之职责及权力之任何公职人员;
“总监”指香港海关总监及任何副总监或助理总监;
“印版”之意义与《版权法》所载意义相同,并包括任何机器、装置或设备。
(2)除本条例另有规定外,本条例所用任何字眼或词句,倘其意义乃版权法载明者,则在本条例内或为执行本条例之目的,其意义应与《版权法》所载意义或为执行《版权法》之意义相同。
3.香港机构作电视广播及播音时受版权限制之行为
(1)引伸至香港之版权法,得在香港地区适用于附表所列机构从香港任何地方所作之电视广播及播音,一如其适用于英国广播电台或英国独立电视局从联合王国任何地方所作之电视广播及播音无异。
(2)为执行本条之规定,在卫星传送的情况下,任何电视广播及播音的制作地方是指向卫星发送广播及播音讯号的地方。
4.已获授权之广播由传播服务系统转播
(1)倘某项电视广播或播音乃附表所列之任何机构从香港任何地方播送,且广播系获授权者,则任何人接收广播后,将节目(内容包括文学、戏剧或音乐作品、或其改编作品、或艺术作品或电影片)转播予传播服务系统之用户收看或收听者,在有关侵犯该作品或影片版权之诉讼中,其地位应如其已持有版权人所发之许可证,可将有关作品、改编作品或影片包括在接收广播后转播于任何节目内,供该传转播服务系统之用户收看或收听者无异。
(2)倘在第(1)款所述情形下,由于该项广播未获授权,以致该名将节目转播之人士侵犯有关版权,则??
(a)该人不得因侵犯该版权而根据版权法或本条例被起诉;但
(b)若附表所列机构作电视广播或播音时曾侵犯该版权,则就该版权而对该机构提出之诉讼中,于评定损害赔偿时,应将该人侵犯版权一事列入考虑。
(3)为执行本条之规定起见,倘有关作品或电影片系由该版权人播放,或经该人认可而播放,则该项广播仅在此等情形下作获授权论。
5.与侵犯版权之版本有关之罪项
(1)在不妨碍版权法第21条之原则下,任何人倘拥有任何作品或其他制作之版本,作贸易或商业用途而该版本乃侵犯该作品或制作根据版权法或本条例享有之版权者,即属违法,一经定罪,可按侵犯版权之版本件数,每件罚款1000元,及监禁12个月;惟若该人能提出令法庭满意之证据,证明其不知道及无理由相信该版本乃侵犯上述作品或其他制作之版权者,则属例外。
(2)在不妨碍版权法第21条之原则下,任何人倘拥有任何印版,用以或企图用以制造任何侵犯某作品或其他制作根据版权法或本条例享有版权之版本,作贸易或商业用途者,即属违法,一经定罪,可被判罚款50,000元及监禁2年;惟若该人能提出令法庭满意之证据,证明其不知道及无理由相信该印版曾用以或企图用以制造侵犯上述作品或其他制作版权之版本者,则属例外。
(3)任何人被控第(1)或第(2)款所指之罪项时,倘法庭相信获授权人员根据第6条检获之任何与该罪项有关之物品??
(a)乃属侵犯某作品或其他制作根据版权法或本条例享有版权之版本;
(b)乃属曾用以或企图用以制造侵犯上述作品或其他制作版权之版本之印版;或
(c)乃属曾用于违反版权法或本条例之任何罪项者,
无论被控犯该罪之人是否已被定罪,均可下令将该等物品??
(i)毁灭;
(ii)交予法庭认为系拥有有关版权之人士;或
(iii)以法庭认为适当之其他方法处置。
(4)倘获授权人员根据第6条检获任何与涉嫌违反版权法或本条例之罪项有关之物品,经律政司或总监向法庭提出申请,而法庭又相信该物品??
(a)乃属侵犯某作品或其他制作根据版权法或本条例享有版权之版本;
(b)乃属曾用以或企图用以制造侵犯上述作品或其他制作版权之版本之印版;或
(c)乃属曾用于违反版权法或本条例之任何罪项者,
法庭可下令将该项物品??
(i)毁灭;
(ii)交予法庭认为系拥有有关版权之人士;或
(iii)以法庭认为适当之其他方法处置。
6.调查人员之权力
(1)任何获授权之人员??
(a)倘有理由怀疑下述地点有任何侵犯某项作品或其他制作根据版权法或本条例享有版权之版本,或有任何曾用以或企图用以制造侵犯此等作品或其他制作版权之版本之印版,则可??
(i)进入任何楼宇或地方搜查,惟须受第7条规定限制;
(ii)截停任何船只(战舰除外)或飞机(军机除外),并登上搜查;或
(iii)截停任何车辆,并加以搜查;及
(b)可检去,移走或扣押??
(i)其认为属于侵犯某项作品或其他制作根据版权法或本条例享有版权之版本之任何物品,或其认为企图用以制造侵犯此等作品或其他制作版权之版本之任何印版;及
(ii)其认为属于或包含或可能属于或包含版权法或本条例所指罪项之证据之任何物件。
(2)任何获授权人员可??
(a)将本条例授权其进入搜查之任何地方之外门或内门破开;
(b)强行登上本条例授权其截停、登上及搜查之任何船只、飞机或车辆;
(c)将妨碍其执行本条例所赋权力之任何人或物件强行移去;
(d)将本条例授权其搜查之任何地方内之任何人士扣留,直至搜查完毕为止;
(e)将本条例授权其截停、登上及搜查之任何船只或飞机扣留,并阻止任何人接近或登上该船只或飞机,直至搜查完毕为止;
(f)将本条例授权其截停及搜查之任何车辆扣留,直至搜查完毕为止。
7.进入及搜查住宅楼宇之限制
(1)获授权之人员不得进入及搜查任何住宅楼宇,除非??
(a)获裁判司根据第(2)款发出搜查令;或
(b)获总监根据第(3)款给予授权书。
(2)裁判司于接获经宣誓之告发后,倘认为有合理理由怀疑在某住宅楼宇内,有任何物品可根据第6条第(1)款(b)段之规定予以捡去、移走或扣押,则可发出搜查令,批准获授权人员进入该楼宇搜查。
(3)总监倘认为有合理理由怀疑??
(a)在任何住宅楼宇内,有任何物品可根据第6条第(1)款(b)段之规定予以捡去、移走或扣押;及
(b)除非立即进入该楼宇搜查,否则上述物品可能被移离该楼宇,
可用书面批准获授权人员进入该楼宇搜查。
(4)凡根据第(2)或第(3)款获批准进入任何住宅楼宇搜查之获授权人员,可要求任何其他获授权人员协助其进入该楼宇及协助搜查。
8.妨碍调查人员工作
(1)在不妨碍其他条例之情形下,任何人士若??
(a)蓄意妨碍获授权人员根据版权法或本条例行使权力或执行职务;
(b)蓄意不遵照获授权人员正当提出之要求办理;或
(c)无合理解释而拒绝向获授权人员提供该人员为根据版权法或本条例行使权力或执行职务而合理需要之任何其他协助。
即属违法,一经定罪,可被判罚款5,000元及监禁3个月。
(2)在获授权人员根据版权法或本条例行使权力或执行职务而要求提供资料时,任何人士如故意提供虚假或有误导成份之资料,即属违法,一经定罪,可判罚款5,000元及监禁3个月。
(3)本条之规定,不得解释为要求任何人提供任何能导致其入罪之资料。
9.作为证据之宣誓书
(1)下述宣誓书倘??
(a)声称由根据版权法享有版权之作品或其他制作之版权人作出,或由该人之代表作出;及
(b)陈述??
(i)在宣誓书所指之时间内,该作品或其他制作系有版权者;
(ii)宣誓书内所指之人士乃该作品或其他制作之版权人;及
(iii)附同宣誓书提交之作品或其他制作副本,乃该作品或其他制作之真正副本,
并符合第(3)款之规定,则在根据版权法或本条例所进行之诉讼中,可毋须进一步证明而被接纳为证据。
(2)根据第(1)款作出之宣誓书呈交法庭后,除能提出反证外,法庭应推定??
(a)宣誓书中之陈述属实;及
(b)宣誓书乃根据第(3)款之规定作出及认证。
(3)为本条之目的而作出之宣誓书??
(a)须经过宣誓??
(i)在英联邦地区内,应在裁判司或公证人面前宣誓;或
(ii)在非英联邦地区,应在英国政府之领事人员或公证人面前宣誓;及
(b)须由作见证人之裁判司、公证人或领事人员就作出宣誓书一事签署认证。
10.起诉期限
任何违犯版权法或本条例之罪项,在违犯后3年期满之后,或在发现该罪项1年之后,即不能起诉,两日期以较后者为准。
11.港督修订附表之权力
港督可在宪报刊登公告,修订附表。

To modify the Copyright Act 1956 as amended by the Design Copyright Act1968, in its application to Hong Kong and to make further provision withrespect to copyright law in Hong Kong.[2 March 1973] L. N. 46 of 1973
WHOLE DOCUMENT
1. Short titleThis Ordinance may be cited as the Copyright Ordinance.2. Interpretation(1) In this Ordinance, unless the context otherwise requires??“Act” means the Copyright Act 1956 (1956 c. 74 U. K.) as amended by theDesign Copyright Act 1968 (1968 c. 68 U. K.);“authorized officer” means any public officer authorized in writing by theCommissioner to exercise any of the powers and perform any of the dutiesconferred or imposed on an authorizedofficer under this Ordinance;(Amended L. N. 294 of 1982) “Commissioner” means the Commissioner ofCustoms and Excise and any Deputy or Assistant Commissioner of Customs andExcise; (Replaced L. N. 294 of 1982)“plate” has the meaning assigned by the Act and also includes any machine,device or equipment.(2) Subject to the provisions of this Ordinance, any word or expressionused herein to which a meaning is assigned by the Act shall have in or forthepurpose of this Ordinance the meaning that it has in or for thepurposes of the Act.3. Acts restricted by copyright in television and sound broadcasts by HongKong organizations(1) The Act as extended to Hong Kong shall apply in Hong Kong to everytelevision broadcast and every sound broadcast made by any organizationspecified in the Schedule from a place in Hong Kong as it applies to everytelevision broadcast and every sound broadcast made by the BritishBroadcasting Corporation or the Independent Television Authority from aplace in the United Kingdom. (Amended 11 of 1992 s. 2)(2) For the purposes of this section, the place from which a broadcast ismade is, in the case of a satellite transmission, the place from which thesignals carrying the broadcast are transmitted to the satellite. (Added 11of 1992s. 2)
4. Transmission of authorized broadcasts by a diffusion service(1) Where a television broadcast or sound broadcast is made by anyorganization specified in the Schedule from a place in Hong Kong, and thebroadcast is an authorized broadcast, any person who, by the reception ofthe broadcast,causes a programme to be transmitted to subscribers to adiffusion service, being a programme comprising a literary, dramatic ormusical work, or anadaptation of such a work, or an artistic work, or acinematograph film, shall be in the like position, in any proceedings forinfringement of the copyright (if any) in the work or film, as if he hadbeen the holder of a licence granted by the owner of that copyright toinclude the work, adaptationor film in any programme caused to betransmitted by him to subscribers to that service by the reception of thebroadcast. (Amended 38 of 1974 s. 2) [cf. 1956 c. 74 s. 40 (3) U. K.](2) If, in the circumstances mentioned in subsection (1), the personcausing the programme to be transmitted, infringed the copyright inquestion, by reason that the broadcast was not an authorizedbroadcast??(a) no proceedings shall be brought against that person under the Act orthis Ordinance in respect of his infringement of that copyright; but(b) if shall be taken into account in assessing damages in anyproceedingsagainst the organization specified in the Schedule making the televisionbroadcast or sound broadcast in respect of that copyright, in so far asthat copyright was infringed by such organization in making the broadcast.(Added 38 of 1974 s. 2) [cf. 1956 c. 74 s. 40 (4) U. K.](3) For the purposes of this section, a broadcast shall be taken, inrelation to a work or cinematograph film, to be an authorized broadcastif, but only if, it is made by, or with the licence of, the owner of thecopyright in the work or film.
5. Offences in connexion with infringing copies(1) Without prejudice to section 21 of the Act, any person who for thepurposes of trade or business has in his possession any infringing copy ofa work or other subject matter in which copyright subsists under the Actor this Ordinance shall, unless he proves to the satisfaction of the courtthat he did not know and that he had no reason to believe that it was aninfringing copy of any such work orother subject matter, be guilty of anoffence and shall be liable on conviction to a fine of $1,000 in respectof each such infringing copy and to imprisonment for 12 months.(2) Without prejudice to section 21 of the Act, any person who for thepurposes of trade or business has in his possession any plate used orintended to be used for making an infringing copy of any work or othersubject matter in which copyright subsists under the Act or this Ordinanceshall, unless he proves to the satisfaction of the court that he did notknow and that he had no reason to believe that the plate was used orintended to be used for making an infringing copy of any such work orother subject matter, be guilty of an offence and shall be liableonconviction to a fine of $50,000 and to imprisonment for 2 years.(3) Where a person is charged with an offence under subsection (1) or (2)the court may, if it is satisfied that any article seized by an authorizedofficer under section 6 in connexion with the offence?? N. 34of 1990)(a) is aninfringing copy of a work or other subject matter in whichcopyright subsists under the Act or this Ordinance;(b) is a plate which has been used, or is intended to be used, for makinginfringing copies of any such work or other subject matter; or(c) has been used in connexion with any offence under the Act or thisOrdinance, order that the article be??(i) destroyed;(ii) delivered up to the person who appears to the court to be the ownerof the copyright in question; or(iii) disposed of in such other way as the court may think fit,whether or not the person charged is convicted of the offence with whichhe was charged.(4) Where any article is seized by an authorized officer under section 6in connexion with a suspected offence under the Act orthis Ordinance acourt, on the application of the Attorney General or the Commissioner,may, if it is satisfied that the article-(Amended L. N. 294 of 1982)(a) is an infringing copy of a work or other subject matter in whichcopyright subsists under the Act or this Ordinance;(b) is a plate whichhas been used, or is intended to be used, for makinginfringing copies of any such work or other subject matter; or(c) has been used in connexion with any offence under the Act or thisOrdinance, order that the article be??(i) destroyed;(ii) delivered up to the person who appears to the court to be the ownerof the copyright in question; or(iii) disposed of in such other way as the court may think fit. 6. Powers of investigating officers(1) Any authorized officer may??(a)(i) subject to section 7, enter and search any premises or place;(ii) stop, board and search any vessel (other than a ship of war) or anyaircraft (other than a military aircraft); or(iii) stop and search any vehicle,in which hereasonably suspects that there is an infringing copy of a workor other subject matter in which copyright subsists under the Act or thisOrdinance or a plate used or intended to be used for making infringingcopies of any such work or other subject matter; and(b) seize, remove or detain??(i) any article which appears to him to be an infringing copy of a work orother subject matter in which copyright subsists under the Act or thisOrdinance or any plate which appears to him to be intended for use formaking infringing copies of any such work or other subject matter; and(ii) anything which appears to him to be or to contain, or to be likely tobe or to contain, evidence of an offence under the Act or this Ordinance.(2) Any authorized officer may??(a) break open any outer or inner door of any place which he is empoweredor authorized by this Ordinance to enter and search;(b) forcibly board any vessel, aircraft or vehicle which he is empoweredby this Ordinance to stop, board and search;(c) remove by force any person or thing obstructing him in the exercise ofany power conferred on him by this Ordinance;(d) detain any person found in any place which he is empowered orauthorized by this Ordinance to search until such place has been searched;(e) detain any vessel or aircraft which he is empowered by this Ordinanceto stop, board and search, and prevent any person from approaching orboarding such vessel or aircraft until it has been searched;(f) detain any vehicle which he is empowered by this Ordinance to stop andsearch until it has been searched.(Amended 38 of 1974 s. 4)
7. Restrictions on the entry and search of domestic premises(1) No domestic premises shall be entered and searched by an authorizedofficer unless??(a) a magistrate has issued a warrant under subsection (2); or(b) the Commissioner has given an authorization under subsection (3).(Amended L. N. 294of 1982)(2) A magistrate may, if he is satisfied by information on oath that thereis reasonable ground for suspecting that there is in any domestic premisesany article which may be seized, removed or detained under section 6 (1)(b), issue a warrant authorizing an authorized officer to enter and searchthepremises.(3) The Commissioner may, if he is satisfied that there is reasonableground for suspecting?? (Amended L. N. 294 of 1982)(a) that there is in any domestic premises any article which may beseized, removed or detained under section 6 (1) (b); and(b) that unless the premises are enteredand searched immediately suchthing is likely to be removed from the premises, authorize in writing anauthorized officer to enter and search the premises.(4) An authorized officer authorized under subsection (2) or (3) to enterand search any domestic premises may call upon any authorized officer toassist him in entering and searching the premises.(Amended 38 of 1974 s. 5)8. Obstruction of investigating officers(1) Without prejudice to any other Ordinance, any person who??(a) wilfully obstructs an authorized officer in the exercise of his powersor the performance of his duties under the Act or thisOrdinance;(b) wilfully fails to comply with any requirement properly made to him byany such authorized officer; or(c) without reasonable excuse, fails to give such authorized officer anyother assistance which he may reasonably require to be given for thepurpose of exercising his powers or performing his duties under the Act orthis Ordinance,shall be guilty of an offence and shall be liable on conviction to a fineof $5,000 and to imprisonment for 3 months.(2) Any person who, when required to give information to an authorizedofficer in the exercise of his powers or the performance of his dutiesunder the Act or this Ordinance, knowingly gives false or misleadinginformation to any such authorized officer shall be guilty of an offenceand shall be liable on conviction to a fine of $5,000 and to imprisonmentfor 3 months.(3) Nothing in this section shall be construed as requiring any person togive any information which may incriminate him.(Amended 38 of 1974 s. 6)
9. Affidavit evidence(1) An affidavit which??(a) purports to have been made by or on behalf of the owner of a work orother subject matter in which copyright subsists under the Act; and(b) states that??(i) at a time specified therein copyright subsisted in the work or othersubject matter;(ii) the person named therein is the owner of the copyright in the work orother subject matter; and(iii) a copy of the work or other subject matter exhibited to theaffidavit is a true copy of the work or other subject matter,shall, if it complies with subsection (3), be admitted without furtherproofin any proceedings under the Act or this Ordinance.(2) The court before whom an affidavit is produced under subsection (1)shall presume, until the contrary is proved??(a) that the statements made therein are true; and(b) that it was made and authenticated in accordance with subsection (3).(3) An affidavit for the purposes of this section shall be??(a) made on oath??(i) before a magistrate or a notary public if it is made at any placewithin the Commonwealth; or(ii) before a consular officer of Her Majesty""s Government in the UnitedKingdom or a notary public if it is made at any place outside theCommonwealth; and(b) authenticated, so far as relates to the making thereof, by thesignature of the magistrate, notary public or consular officer before whomit is made.10. Time limit for prosecutionsNo prosecution for an offence under the Act or this Ordinance shall becommenced after the expiration of 3 years after the commission of theoffence or 1 year after the discovery thereof, whichever date last occurs.11. Governor""s power to amend the ScheduleThe Governor may, by notice in the Gazette, amend the Schedule.
